Interesting new way to avoid Malpractice Suits

Went to the doctor today. Specifically a Urologist. Had in my mind all the recent heated debates on my web site about doctors and malpractice, and lack of education. I also remembered the many times I've stated that there are some doctors out there who know their stuff, and how impressed I've been with the doctors at Scripps Hospital in La Jolla.

So that's where I went.

I've had recurring epididymitis since several months of on and off testicle ache while on Propecia. Testicle ache is a documented side effect of Propecia, and Im pretty convinced at this point that at least for me, Propecia initiated an easily aggrivated testicle for me that now experiences frequent inflammation with very little physical aggravation. For me, its pretty much going to be an ongoing condition I'm afraid.

So I went to the urologists office and they hand me this paper that I had to agree to sign. It says:

"It is understood that any dispute as to medical malpractice due to unnecessary, or unauthorized, or improper, or negligent, or incompetently rendered services by this doctor... will be determined by submission to arbitration, and not by a lawsuit or court process. By signing this paper you are agreeing to give up your constitutional right to have any such dispute decided in a court of law before a jury, and instead are accepting the use of arbitration."

Then in big letters at the bottom: "BY SIGNING THIS CONTRACT YOU ARE AGREEING TO HAVE ANY ISSUE OF MEDICAL MALPRACTICE DECIDED BY NEUTRAL ARBITRATION AND YOU ARE GIVING UP YOUR RIGHT TO A JURY OR COURT TRIAL."


They wouldn't see me unless I signed this.

On a more positive note, the doctor I saw was incredibly knowledgeable, completely bald, and completely helpful. When I engaged him in discussions that used terms like "testicular torsion", he did not get cocky or act like someone was stepping on him, as many others I've seen tend to do. He actually responded like a normal person, enjoyed the fact that I knew a lot about his specialty, and engaged me in a more technical discussion on the topics at hand. I expected nothing less from a Scripps Hospital physician.

He theorized that 3 years of ignoring repeated testicle pain while on Propecia (a documented side effect) may have resulted in a hypersensitive epididymus in that testicle, which now (and he's right) gets painful and enflamed with very little physical groin exertion (lifting, squatting) and or sometimes unintended reflux passage of urine back into that area of the testicular tubing.

Didn't he think of a cyst in the epidiymus region at first?

I've had one for like 10 years in this region. It used to cause a little pain if i stayed sitting or squatting for long periods, but not anymore. It hasn't changed at all over the years, just causes this occasional little pain but very rarely.

Any statement asking you to surrender your "constitutional rights" can't possibly be a good thing :eek:

Yeh sounds painful...still, I would rather have HairLossTalk.com hair (which I personally don't consider has any real hairloss) and have testicle ache than have my hair and no testicle ache :?

I've had my balls fondled by several doctors and no lumps were found in the right testicle. I had an ultrasound done last year and no cysts were found in the right testicle either. Funny, this time around he found a cyst... only it was on the top front of the left testicle, where I've had no problems whatsoever. He says its harmless anyways, and rather common. Nothing to worry about. But the right testicle, which, even at this moment still aches a little, is theoretically 100% fine.

Regarding HairLossTalk.com hair.... ill take that as a compliment. You are right. I have been fortunate. I wouldn't say "no hair loss" but many people do look at me and say that because Im able to hide the thinning, and the thinning is very minor still. I attribute this entirely to getting on maintenance treatments within 2 months of noticing first loss. I didn't wait.

Based on my family history, my father, and my grandfather, I should have lost about 3 inches off my hairline by now. By age 26 both of them were hating life. There was no way I was supposed to make it to 30 with an in tact hairline (even if it is about 50% less dense than I started with). I will be 30 in august, and Propecia totally maintained for me. I lost some density in the first inch of hairline when dropping Propecia, but I've kept status quo with Revivogen and Topical spironolactone and Nizoral so far.

Im really hoping this site will help young guys catch their hair loss immediately, and ... i honestly truly believe that seeing bald guys will become a thing of the past. The awareness of treating hair loss successfully is very new. There only was Regrowth.com in 1997. Hairsite was around but its really difficult to get a straight answer on what works there. Then we came around in 1999 and hairlosshelp. So these sites are putting the awareness out there, and they're only about 6 years old. I think probably in the next 10 years, assuming people are seeking help, they'll find these sites, and everyone will be on a maintenance regimen, instead of a regrowth regimen.

Anyone have any thoughts on the paper they made me sign? Seems a bit .... weird.

The logical outcome from excessive litigation. However, in CA, it likely has no real impact!

Way off topic but I found it's best to bite your lip if you have an attractive female Doctor giving the berries a good once over, just in case.
