Hey HairLossTalk.com... I was in Vegas this weekend for a bachelors party and got to talking with one of my very good old friends who happens to be a practising lawyer. Without giving any names, I told him about your problem that you have been having with a**h** Kevie boy and his harassment. Great news for you! It turns out that you are holding all the cards my man and if Kevin tries to take you to court he's fucked.

Basically, as I have said, my friend confirmed that in order for him to take any sort of legal action, the burden of proof is on HIM to show that you were the source of the spam. And, no, not just your "from" email address is sufficient. Such things can be faked and my friend says that this sort of thing happens all the time. Well, if he takes you to court, you my dear friend should hire a top notch lawyer and explain this whole situation to him. Because, after he unsucessfully tries to pin the spam on you, you can countersue him for "abuse of process" which is used to protect people as yourself from assholes like Kevin who attempt to misuse legal action to bilk people out of money, among other reasons. AND, he would be liable to pay you punitive penalties equal to TRIPLE all of your damages inflicted in defending yourself.

If he takes no court action, and continues to send messages to your hosting providers accusing you of being a spammer when in fact you are not, you should have a VERY strong case against him for defamation of you and your business. Keep copies of every email he sends you and delete nothing. You can sue his f*****g *** of for some of the things he is saying about HairLossTalk.com dot com.

Talk to a lawyer. Don't let this slide by, my friend says you should have talked to a lawyer when this first started, and you have very strong grounds for showing Mister Kevin Wilson which end the sh*t comes out of, so to speak. He is making a very big mistake with what he is doing with you.

Oh, and additionally, he strongly suggested that after seeing an attorney you should have this attorney send him a letter. He says that the letter should state that you did not create the spam, and that if he attempts to take this to court he will lose, and he will be countersued for abuse of process and will lose again.

Then, the letter should state that as he is unable to prove that the spam comes from you, he should cease any further communications to your business associates (your host) that make damaging claims to your reputation as a businessman, or you will file papers for a defamation suit.

He says this is the easiest you should be on him. He said personally that if it were up to him, the letter he would send out would have the first paragraph I wrote, informing him of abuse of process and his inability to prove you did it... but instead of having a second paragraph asking him to shut up, he would just leave that out and just attach the first para to your defamation countersuit papers, kindly telling him you'll see his sorry *** in court. This is just my friend's opinion, though. Keep in mind, he's a lawyer too! lol
